To the maximum extent permitted by law, Rekna shall not be liable for indirect, incidental, consequential, or punitive damages.

Rekna’s total liability shall not exceed $100 USD or the amount paid by you to Rekna in the preceding 12 months, whichever is greater.

You agree to indemnify and hold harmless Rekna from any claims arising out of your use of the Services or violation of these Terms.

14. Publicity

With your consent, Rekna may reference your organization as a customer or collaborator for factual, non-misleading purposes.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding arbitration on an individual basis, and not in a class, consolidated, or representative action. The arbitration shall take place in Travis County, Texas.

16. Miscellaneous

These Terms constitute the entire agreement between you and Rekna regarding the Services.
If any provision is held unenforceable, the remaining provisions remain in effect.
